Cease and Desist? Part 1

The revelation concerning a Cease & Desist letter authored by Loretta Serrano, owner of http://www.misfitting.com/, took me by surprise because I wasn't notified. After viewing a copy of the document Cathy received, I noticed Loretta made a grave error in attempting to transmit the communication to me. The self-proclaimed sleuth sent it to an email account that's been closed for nearly four years and in doing so... shot herself in the foot!

I have NEVER posted my full legal name in cyberspace on any forum in all the years I’ve had access to the Internet. I’ve never posted my spouse’s name either. Needless to say, when Loretta Serrano aka Loretta Dillon published my personal information at bullybuster burlesque I was perplexed as to how she knew my last name. Puzzle solved!

When Laci Peterson went missing in 2002, I had an ISP with a monthly rate that allowed a limited number of hours. After receiving a hefty bill for exceeding my allotted time I activated a new account with a different service provider that offered unlimited usage. Since I subscribed to various Yahoo groups along with Modbee updates in the original account, I chose to phase it out rather than close it immediately. It became a back-up account where my Peterson case information was temporarily stored until I had time to sort through the documentation. It was also tied in with my Paypal account.

After four months of posting at misfitting.com, I made a contribution through Loretta's Paypal icon. Obviously the email address to my old account accompanied the donation. When the funds were transferred I was identified as the account holder, which is confirmed in Loretta’s note of thanks. Naturally, the account was in my legal name.

The "PAYPAL *RETZQ". transaction listed the account holder’s name as Loretta Smith NOT Loretta Serrano. I don’t know what the repercussions are for opening an account under a bogus name with a company that handles cash transactions. Perhaps the impending Lori Drew trial will spell it all out for us.

The fact is, Loretta’s last name was Smith when she attacked Miss Loveliness in 1998. The assault took place six months after Loretta was awarded a lump sum payment of $9,500.00 for child support in the case of Smith vs Smith , which was ordered to be paid in full by 7/3/98. Yet, within six months, Loretta filed an affidavit of indigency that was approved on 1/13/99 qualifying her for a public defender at the taxpayer's expense. She listed assets of $20.00 cash on hand, $100.00 in checking, and $2500.00 in savings. Missing from the financial disclosure was the recent $9500.00 child support payment, although she added a curious notation alleging, “We are saving for college”.

But I digress.

Any respectable person would be horrified that Loretta Serrano harvested a legal name through a secured electronic cash transfer that she profited from, and then publicized the name while inciting others to cause mental stress. It’s precisely what the bastard did and the evidence is irrefutable. Furthermore, it puts her in the hot seat according to Ohio Stalking Laws , and it should give pause to anyone who entertains the notion of donating to her blog.

It also contradicts Loretta’s version of how personal information was compiled for publication at the fifteen spite blogs she and her partner Anne Curi created.

“The information that was published was obtained in entirely overt (rather than covert) ways:
1. Public records online
2. Personal history
3. Blog posts/comments from existing web sites/blogs on which various people posted their information.
4. Posts and IP tracking from various blogs, namely all the blogs I had as well as others' blogs on which people posted.
5. Emails

None of the personal information was obtained in any underhanded way. All of it was easily obtained and all it took was a little sleuthing. After all, the original premise of everyone's interest in Misfitting was the crime story element. We were little cyber sleuthers, dontcha know.

Personally, I did very little to sleuth. I was too busy or lazy to do it and I always had plenty of volunteers who had lots of time on their hands and were more than happy to do it.

Yes, despite my maligned reputation, I really did not have much time or desire to chase people around the Net. Most of that chasing was done by others (many others) and the info was handed to me on a silver platter.”

Loretta Serrano spent years destroying her own reputation on every major forum in Cyberspace. It didn’t matter whether you were nice to her or found fault with her; Loretta treated everyone that crossed her path with equal disdain. Jbean from Websleuths can attest to that reality.

The “silver platter” is actually quite tarnished.

A photo of my residence was unlawfully swiped from a
reevaluation website and subsequently published on a blog Loretta and company created under my legal name. That act violated the company’s ‘Terms and Conditions of Use’ as well as Copyright Laws and is prosecutable under the governing law and jurisdiction of the state of Rhode Island!

Hacking into a yahoo account and stealing emails is indeed a "covert” operation. It's also against the law! The account belonged to Loretta’s sister.


And then there's the chat transcript between Chrishina Leann Hart and another person that was published on one of the spite blogs. Was it a donation?

A classic example of how Loretta Serrano recruited her band of misfits to do her bidding dates back to December 2005 as she posted under yet another alias!

Exhibit C:

“I'd like to run something by the academy before I do anything. The first time I posted a reward on Aneedaturnbacktime and JA on my blog, D-Paula about fainted.

I know that she would not feel that way, now.

However, I don't think the mutts trust me, and it would be a lot more effective coming from one of you or a group of you.

If one or more of you would sponsor a bounty on Samantha, I would underwrite it. I think it is very possible that with a little financial incentive, someone will spill on her.

Think about it. I will go as high as $1000.

Fascinating! The former indigent offered $1000 for information about a self-professed Internet troll with the brain functionality of an artichoke! Of course this bounty came on the heels of Loretta blaming Peace for things Chrishina/Samantha had done at Usenet. Loretta not only posted personal details about Peace, but also violated the privacy of her family members by publicizing names and providing links to their websites.

Loretta traumatized Peace and threatened to call her employer. The entire exchange is still floating around cyberspace THREE years after the fact! And when all was said and done, Peace felt worse for the children.

The most appalling (to me), hateful, and hurtful things that have been done by Loretta, to any of us, is what she did to Anita... when she posted Anita's children's names, location and other info and what she did to Katie... well, we ALL know what she did to Katie.”

"For the record, I posted Lora's kids' names and BDates and her new address on Usenet and my blog to prove a point. I realized that it was going to stay in some venue permanently, as did all the posts that (Names edited) and all the mutts who used my daughter's name and my name to slander me at Usenet. I realized that it was not an appropriate venue for that, but I did it anyway.

Did I feel bad about it? Yes, actually. You can ask the people in the kitchen what I said. I said, I know it was wrong, but I did it anyway. Does that make me a sociopath? Have at it. I am no more pathological than you all, and in fact have not done a fraction of the things of which you accuse me."

The disclosure set a standard for irrational, immoral and self-destructive behavior that would take Britney Spears five months to surpass.
